HSDW Collaborates with the American Bar Association on Brief of Amicus Curiae in Haaland v. Brackeen

On August 18, 2022, the American Bar Association filed a brief in Haaland v. Brackeen, No. 21-376, in support of the Federal Government and Intervening Tribes to defend the constitutionality of the Indian Child Welfare Act.  The brief was coauthored by Geoff Strommer, Caroline Mayhew, Katie Klass, Gregory Smith, and Rick Frye in collaboration with the ABA’s Native American Concerns Committee and the ABA Center on Children and the Law.  This brief marks the first occasion that the ABA has taken a position in a case before the Supreme Court concerning Federal Indian Law Issues.
