BLM Extends Comment Period for Proposed Rule on Hydraulic Fracturing on Public Lands and Indian Lands

On June 26, 2012, the Bureau of Land Management (BLM) published a notice in the FEDERAL REGISTER extending the comment period for the proposed rule on hydraulic fracturing on public lands and Indian lands by 60 days. Comments are now due by September 10, 2012. In the attached notice the BLM cites “the complexity of the [proposed] rule and the issues surrounding it” as the reasons for extending the comment date.

The proposed rule would require disclosure to the public of chemicals used in hydraulic fracturing on public lands and Indian lands, strengthen regulations related to well-bore integrity, and address issues related to “flowback” fluids. See our General Memorandum 12-068 (May 25, 2012) for the text and summary of the proposed rule.

Please let us know if we may provide additional information on the proposed regulations or assistance in preparing comments.
