Bureau of Fiscal Service Issues Notice of Proposed Rulemaking Regarding Management of Federal Agency Disbursements

On April 29, the Bureau of Fiscal Services (“Fiscal Services”) at the Department of Treasury (“Treasury”) issued a Notice of Proposed Rulemaking (NPRM) requesting comments on the limited circumstances under which paper check disbursements may be made by federal agencies in accordance with Executive Order (E.O.) 14247 Modernizing Payments to and From America’s Bank Account.

Generally, E.O. 14247 directs the Secretary of the Treasury to cease issuing paper checks for all Federal disbursements. However, the NPRM notes that the June 2025 Request for Information (RFI) on E.O. 14247 yielded comments from Tribal governments related to a range of Tribal considerations to be accounted for, including possibly higher rates of unbanked and underbanked individuals and a lack of technological infrastructure in Indian Country. In response to these concerns, the proposed rules would provide a new waiver category available to agencies for payments “made to individuals or entities located on Indian land lacking the infrastructure to support electronic funds transfers.”

Comments on the proposed rulemaking are due on or before June 15, 2026 and may be submitted electronically through the Federal Government eRulemaking portal here.
