Bureau of Indian Affairs Seeking Tribal Consultation on Budgetary Needs and More Regarding State Criminal Jurisdiction Under Public Law 83-280

The Bureau of Indian Affairs and Office of Justice Services (BIA/OJS) is inviting Tribal leaders to a consultation on August 7, 2024, at 1:00 PM ET on Zoom to provide feedback regarding budgetary needs on Tribal law enforcement and Tribal judicial systems in Public Law 83-280 states. The registration link is here. BIA/OJS is accepting written comments submitted to consultation@bia.gov no later than August 14, 2024.

The BIA/OJS is seeking consultation with Tribes that are located in Public Law 83-280 states that mandate state criminal jurisdiction over crimes committed on Indian land. They are specifically looking for consultation on budget needs for Tribal law enforcement and Tribal judicial systems. They are also open to hearing any other comments, concerns, and recommendations regarding state jurisdiction on Public Law 83-280 Tribal lands.

The Bureau of Indian Affairs is directed to conduct Tribal consultations in the FY 2024 Consolidated Appropriations Act. The Consolidated Appropriations Act specifically asks the BIA to consult on “the budgetary needs of Tribal law enforcement, including wellness courts and other essential judicial needs for the Tribes in these States[.]” The BIA/OJS is directing any questions to Kevin Martin, Office of Justice Services, at kevin.martin@bia.gov or at (202)-657-3620.
